How we handle it, step by step
Contract and clause review
We read the contract and its dispute resolution clause: whether there is an arbitration agreement, the seat, the number of arbitrators, any institution named, and any negotiation or mediation steps required before arbitration.
Negotiation and notice
We open structured negotiations. If they fail, we send a notice invoking arbitration under Section 21 of the Arbitration and Conciliation Act, 1996. The date the other side receives it marks the start of the arbitration, which matters for limitation.
Conciliation or mediation
A neutral conciliator or mediator helps the parties reach terms. A settlement agreement signed in conciliation under the 1996 Act has the same status as an arbitral award. For commercial suits that do not need urgent relief, mediation before filing is mandatory under Section 12A of the Commercial Courts Act, 2015.
Constituting the tribunal
Arbitrators are appointed as the contract provides. If the other party does not cooperate, we apply to the High Court for an appointment under Section 11.
Arbitral proceedings
Pleadings are to be completed within six months of the tribunal's appointment. In a domestic arbitration, the award is due within twelve months of the completion of pleadings, extendable by six months by consent and further only by the court. Interim relief is available from the tribunal or the court.
Award, settlement and enforcement
If the parties settle during the arbitration, the tribunal can record the settlement as an award on agreed terms. An award can be challenged within three months under Section 34, extendable by up to 30 days, and is otherwise enforced like a court decree.
